Terms and Conditions of Use

1. General Information

Genealogica is a private, independent project and is not affiliated with state archives or public authorities. Paid services are supplied by the legal entity identified before ordering and on the fiscal document. Use of the site implies acceptance of the terms below.

Acceptance of terms: By accessing and using the Genealogica platform, you confirm that you have read, understood, and fully accepted these terms and conditions. If you do not agree with any of the provisions of this document, please do not use the site.

Changes to terms: We may update these terms to reflect service changes, legal requirements, or security measures. Material changes will be published with the updated date and, where reasonably possible, communicated through the site, account, or e-mail before taking effect. They will not retroactively reduce benefits for an already-paid period. If you do not agree, you may stop using the service and stop subscription renewal, without affecting mandatory statutory rights.

2. Rules of Use

  • Personal access and use: You can search the database for free (by name, locality, source). The information obtained is intended exclusively for personal, historical, or academic research and cannot be used for commercial purposes.
  • Account and credits: Detailed viewing of records requires creating a Genealogica account. Access is managed through a credit system. The same Genealogica account may also be used to access the Genealogica forum. To make forum participation work normally, a forum profile may be linked to your account or created for it. Forum participation remains subject to the forum rules.
  • Multiple accounts: Creating multiple platform or forum accounts by the same person to accumulate free credits, bypass moderation, evade restrictions, or manipulate community features is strictly prohibited. Detection of these practices may lead to suspension or deactivation of all associated accounts.
  • User responsibility: You are responsible for maintaining the confidentiality of authentication data (username and password). Any activity carried out under your account will be considered performed by you, and responsibility for respective actions belongs entirely to you. If you suspect unauthorized use of your account, you are obliged to notify us immediately.
  • Source citation: We encourage the use of information in specialized works or publications, provided the source is correctly indicated. Proper citation protects the work of our team and contributors, while ensuring traceability and credibility of sources for your future research.

    A. For published volumes (edited sources):

    • The primary source (published volume) is cited first, followed by mention of the Genealogica database.

    B. For unpublished archive registers (transcribed on the site):

    • The complete archival reference is cited, along with contributors to the transcription and the database.

  • Commercialization: Selling or redistributing lists and records obtained from this site for a fee is strictly prohibited. Information is made available for personal and academic use, not for commercial profit.
  • Automation (Scraping): Systematic extraction of content through automated software (bots, crawlers, scrapers, scripts, or similar tools) is prohibited without our written permission. Reasonable indicators of unauthorized automation may trigger a review and temporary restrictions; confirmed breaches may lead to account suspension or deactivation and subscription termination under the security and payment sections below.

User-submitted content, burials, documents, and publications

The following additional rules apply to cemetery submissions, grave submissions, photos, batch files, narrative documents, publication proposals, bibliography metadata, and other materials submitted by users:

  • Your right to submit content: You represent that you have the right to upload, transmit, or otherwise provide the submitted materials and information, that they do not infringe copyright, image rights, confidentiality obligations, or other third-party rights, and that you have any consent or other legal basis required for data relating to living persons.
  • License granted for submitted materials: You retain whatever rights you hold in your submitted materials, but you grant Genealogica a non-exclusive, royalty-free, worldwide license to store, technically copy, process, resize, adapt, index, moderate, and publish those materials within the platform, the related public pages, and the backups necessary to operate the service.
  • Moderation and editorial handling: We may keep submitted materials private pending review, refuse a submission, edit metadata, normalize titles, links, citations, or obvious formatting, technically crop or resize images, and later remove content that is inaccurate, offensive, disputed, or otherwise unsuitable for the documentary, memorial, and research purpose of the platform.
  • Respect, memorial character, and living-person data: Do not submit unlawful, defamatory, violent, obscene, discriminatory, or otherwise harmful content, including content that disrespects the dignity of buried persons, documentary sources, authors, contributors, or local communities. Avoid publishing sensitive data about living persons and ensure that funeral photos, document transcriptions, bibliographic notes, and related descriptions remain appropriate to the platform's documentary, memorial, and research purpose.
  • Corrections and removals: If you are a rights holder or affected person and believe a submitted item should be corrected or removed, you may contact us at contact@genealogica.ro or via the contact form. Account deactivation or erasure does not automatically remove already published public contributions or forum posts; those requests are reviewed separately so we can balance privacy rights, legal obligations, third-party rights, moderation needs, and the continuity of the historical or community record.

Payments, credits, and subscriptions

Credits and subscriptions may be purchased only from an authenticated Genealogica account with a verified e-mail address. The responsible legal entity, price, and currency are determined by the selected offer and shown before Stripe payment.

  • Price and confirmation: The total price, currency, frequency, and benefits are shown before the order is submitted. Payment is confirmed only after confirmation by the payment provider, and the fiscal invoice reflects the gross amount paid by the customer.
  • Paid credits: The one-time package adds the displayed number of credits to the account. Credits are personal, non-transferable, are not electronic money, and cannot be exchanged for cash; they are used only for the Genealogica features identified by the credit system.
  • Recurring subscription: A Genealogica Plus subscription renews monthly at the displayed price until canceled. Friend, Supporter, and Benefactor provide monthly allowances of 150, 250, and 400 credits respectively. The Plus allowance is the level’s total monthly allowance, not a bonus added on top of the remaining balance: after each confirmed initial or renewal payment, the free-credit balance is replenished to the allowance applicable to the account. An immediate upgrade starts a new monthly period, is charged in full at the new level’s price, and replenishes the balance after payment is confirmed. An account cannot hold two Genealogica subscriptions for the same billing entity at once.
  • Cancellation: The subscription can be canceled from My payments or the secure Stripe portal. Ordinary cancellation stops renewal and takes effect at the end of the already-paid period; benefits granted for that period remain available until then.
  • Right of withdrawal: Mandatory consumer rights, including a right of withdrawal where applicable, remain unaffected. If you request immediate supply and fully use a digital benefit, a statutory exception may apply only when the legally required conditions and confirmations are met; payment alone is not treated as a blanket waiver of rights.
  • Refunds: Requests are assessed against the payment, credits already used, the subscription period, and mandatory consumer rights. An accepted refund may revoke unused paid credits and will be accompanied by the required fiscal correction documents.
  • Abusive use and termination of paid services: If there are reasonable indicators that a subscription, credit pack, or account is used for scraping, unauthorized automation, fraud, limit evasion, exploitation of vulnerabilities, or other conduct that harms the platform or its users, we may temporarily restrict access while reviewing the matter. If the breach is confirmed or the risk is serious and urgent, we may suspend or deactivate the account, stop renewal, and terminate the subscription. Measures will be proportionate to the risk; where security permits, we will explain the reason and how to request clarification. Amounts and benefits for the paid period, as well as unused credits, will be handled according to applicable law, services already supplied, and the circumstances; suspicion alone does not remove mandatory consumer rights.
  • For a payment issue, first use the contact form. Consumers may also use ANPC's official SAL platform for alternative dispute resolution.

3. Security and access restriction

To protect platform integrity and prevent abuse, we review the relevant technical signals and activity described in the Privacy Policy. We may request verification or temporarily restrict access when there are reasonable indicators of:

  • Repeated and excessive access to records within a short time frame, behavior specific to automated activity (robots, scripts).
  • Attempts at systematic copying or mass extraction of the entire database.
  • Abusive use of offered facilities, including manipulation of the credit system or exploitation of technical vulnerabilities.

In urgent security situations, obvious fraud, or risk to the platform or other users, measures may be applied without advance notice. In other cases we aim for a proportionate response and, where possible, explain the reason. Serious or repeated breaches may lead to permanent account deactivation and termination of paid services. 4. Limitation of liability

  • Data accuracy: We assume no responsibility for any transcription, indexing, or data entry errors or inaccuracies, which are inherent to the complex process of interpreting and processing historical documents. Although we make considerable efforts to ensure information accuracy, we recommend verifying critical data with original sources whenever possible.
  • Service availability: We cannot guarantee uninterrupted operation of the site. Service may be interrupted for maintenance, updates, security, or unforeseen technical incidents, and we will take reasonable measures to limit their duration and impact. Nothing in these terms excludes or limits rights and remedies that cannot lawfully be restricted, including those applicable to paid digital services.

6. Intellectual Property

  • The database structure, site interface, graphic design, and all software elements belong to the administrators of the Genealogica platform and are protected by copyright legislation.
  • Historical documents and genealogical information are considered public heritage and can be used freely in accordance with the purposes mentioned in these terms, except for those protected by copyright of authors or editors explicitly mentioned.
  • Users retain full rights over research, analysis, and studies of their own carried out based on data accessed through this platform.

7. Applicable Law

These terms and conditions are governed by Romanian law and will be interpreted accordingly. Disputes will be determined by the courts competent under applicable rules, without restricting any mandatory consumer protection or jurisdiction available to consumers.
